TERMS OF SERVICE AND LIABILITY WAIVER

CLEANING PLATFORM SERVICES

IMPORTANT NOTICE: PLEASE READ CAREFULLY BEFORE USING OUR SERVICES

By using Broom The Room, LLC's website and booking services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and Liability Waiver.

1. NATURE OF SERVICE

Broom The Room, LLC ("Company," "we," "us") operates an online platform that connects customers ("you," "Customer") with independent cleaning professionals ("Service Providers"). We are a technology platform only and do not provide cleaning services directly.

2. INDEPENDENT CONTRACTOR RELATIONSHIP

CRITICAL DISCLOSURE: All cleaning professionals with whom you may be connected from our platform are independent contractors, not employees of Company. Service Providers:

  • Set their own schedules and methods

  • Use their own equipment and supplies (unless otherwise arranged)

  • Are responsible for their own taxes, insurance, and licensing

  • Work independently and are not supervised by Company

  • May work for other platforms or customers

3. NO EMPLOYMENT RELATIONSHIP

Company EXPRESSLY DISCLAIMS any employer-employee relationship with Service Providers. We do not:

  • Provide workers' compensation coverage for Service Providers

  • Withhold taxes from Service Provider payments

  • Provide benefits to Service Providers

  • Exercise control over Service Providers' work methods

  • Guarantee Service Provider availability or performance

4. COMPREHENSIVE LIABILITY WAIVER

BY USING OUR SERVICES, YOU VOLUNTARILY ASSUME ALL RISKS AND WAIVE ALL CLAIMS against Company for:

Property Damage

  • Damage to personal property, furniture, fixtures, or real estate

  • Loss or theft of items during cleaning services

  • Damage from cleaning chemicals, equipment, or methods

  • Water damage, scratches, breaks, or other physical harm to property

Personal Injury

  • Any injury occurring on your premises during service

  • Allergic reactions to cleaning products

  • Slips, falls, or accidents involving Service Providers or household members

  • Any health impacts from cleaning chemicals or methods

Service Issues

  • Unsatisfactory cleaning results or incomplete work

  • Service Provider no-shows, delays, or cancellations

  • Disputes over pricing, payment, or service scope

  • Professional misconduct or negligence by Service Providers

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Company's total liability for any claim shall not exceed the service fees paid to Company for the specific booking giving rise to the claim.

COMPANY DISCLAIMS ALL WARRANTIES, express or implied, including merchantability and fitness for a particular purpose.

COMPANY SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages

  • Lost profits, business interruption, or opportunity costs

  • Damages exceeding $100 per incident, regardless of cause

6. CUSTOMER RESPONSIBILITIES

You agree to:

  • Verify Service Provider credentials independently if desired

  • Secure valuable items before service begins

  • Provide safe working conditions and disclose any hazards

  • Communicate requirements clearly to Service Providers

  • Resolve disputes directly with Service Providers when possible

  • Hold Company harmless from claims arising from your use of the platform

7. BACKGROUND CHECKS AND SCREENING

While Company may conduct basic identity verification, we do not guarantee the results of any background checks or screening processes. Customers are encouraged to:

  • Meet Service Providers before service begins

  • Conduct their own screening if desired

  • Trust their judgment about allowing access to their property

8. INSURANCE DISCLAIMER

Company does not provide insurance coverage for Service Providers' work. Customers should:

  • Verify Service Provider insurance coverage independently

  • Check their own homeowners'/renters' insurance for coverage

  • Consider additional insurance if desired

9. INDEMNIFICATION

You agree to indemnify and hold harmless Company, its officers, directors, employees, and agents from any claims, damages, costs, or expenses (including attorney fees) arising from:

  • Your use of the platform

  • Your interactions with Service Providers

  • Any violation of these terms

  • Any negligent or wrongful acts on your part

10. DISPUTE RESOLUTION

Direct Resolution

Disputes should first be addressed directly with the Service Provider involved.

Binding Arbitration

Any claims against Company must be resolved through binding arbitration in Colorado, under Colorado law. You waive the right to jury trial and class action participation.

11. GOVERNING LAW

These terms are governed by the laws of Colorado, without regard to conflict of law principles.

12. SEVERABILITY

If any provision is deemed invalid, the remainder of these terms shall remain in full effect.

13. ACKNOWLEDGMENT

BY CLICKING "I AGREE" OR USING OUR SERVICES, YOU ACKNOWLEDGE:

  • You have read and understand these terms

  • You voluntarily assume all risks described above

  • You waive claims against Company as described herein

  • You understand Service Providers are independent contractors

  • This waiver is intended to be as broad as permitted by law
